Competition Policy Issues: HK Competition Commission Submission/Hamburg Sud-Maersk Merger
The Hong Kong Competition Commission on an application for an exemption for a Vessel Discussion Agreement by the HK Container Lines’ Association, on behalf of the HK Shippers’ Council. The GSF submission states that the application is invalid as its application is in compatible with the provisions for exemption under the HK Competition Order as the carrier’ application provides no evidence to support its claim that VDA’s provide benefits to shippers and, bizarrely, the HKLA’s claims that the HKCC should allow the exemption as it is compatible with Singapore Competition Law-not HK Competition law!
DG Competition regarding the proposed acquisition of Hamburg Sud by Maersk. The submission asks the Commission to thoroughly investigate potential restrictions to competition on thin trade routes and in specialist reefer market against the backdrop of enhanced market concentration and potential information sharing in VSAs and VDAs which may restrict competition and choice for shippers.
